5.25 million verdict for disability discrimination

A jury delivered a $5.2 million verdict in favor of John J. Perlstein and Dan Reisman’s client Chris Curry, a man in a wheelchair, against a group of defendants including Academy Pointe and JK Residential services, two subsidiaries of the prominent LA property management company JK Properties. The jury found that the defendants violated the California Fair Employment and Housing Act and Curry’s civil rights by neglecting repairs on essential elevators in Curry’s apartment complex. In addition to causing emotional and financial loss, the defendants’ inaction prohibited Curry’s ability to leave his apartment, leaving him periodically stranded for days at a time and requiring calls to the fire department to carry him to his unit. Despite multiple requests for property owners to address the situation, property owners failed to address the situation until they were cited twice in August 2015.
